Limitation Problem

Hi
I had an accident in 2006. I went to a solicitor who was recommended by my insurance company. He was OK, but he left the company after about a year since when I've been passed from pillar to post. I must have dealt with 5 solicitors in all. Anyway, things haven't really progressed. I hadn't heard from them in ages so I rang them up and all I was told is that there was a 'limitation problem'. They said I needed to speak to another solicitor and would write to me about it but they've not been in touch since.

Can you tell me what I should be doing?

Hi Bob

I'm afraid it sounds as though your solicitors may have missed the limitation date. Personal injury claims have to be brought within 3 years. If the solicitor hasnt issued court proceedings within that period then you've probably lost the chance of pursuing your claim.

All is not lost however. If the limitation date has been missed then you can make a claim against the solicitor for professional negligence. You can seek compensation for the money you would have recovered from your injury claim, had the limitation date not been missed.
