Hi,

At my work we have to carry hot trays with inadequate oven gloves as they still burn you hand despite using them.

I got 2nd degree burns according to the doctor.

Can I make a claim?

Potentially you have a claim because your employers owe you a duty of care to ensure that you are provided with a safe place of work, safe system of work and suitable work equipment. If they don't and you suffer an accident as a result then that is where you could be entitled to compensation.

In your case there is an argument that you should have been supplied with proper gloves. It is what lawyers call "foreseeable" (or likely) that someone carrying hot trays could burn themselves and therefore your work should have done more to prevent this and lessen the risk. Providing suitable gloves or eliminating the need for you to carry the hot trays in the first place would have reduced the risk and their failure to do so is where they have breached the duty of care they owe you as an employer.

If you have complained about this in the past and still nothing has been done then the case is even stronger.

There is an awful lot of health and safety legislation to protect workers and that is because there is such a likelihood of accidents in the workplace and it is important that employees are protected and not put in positions where they could suffer injury. Some people think there is too much legislation but to be honest they are usually the employers who you have to look out for as they have little interest in the safety of their staff.
